High Court Case – Railway to continue recruitment of wards of its staff after VRS

Sub: LARSGESS Appointment of the eligible wards in posts with Grade Pay Rs.1800 and Rs.1900.

Ref: This Office letter of even number dated 1 1.05.2017.

In continuation to this Office letter of even number dated 1105.2017 cited and in view of the stay granted by the Hon’ble High Court of Karnataka, Bengaluru in W.P.Nos. 6845-6896/2017, it is informed in due consultation with Law Department that:

(1) The Divisions/Units may proceed further to process appointment of wards of Railway employees under LARSGESS, subject to outcome of the Writ Petition No.6845-6896/2017.

2. It may be made clear to the employees as well as the candidates that the appointment is subject to the decision to be given by the Hon’ble High Court of Karnataka in the above Writ Petition. In the event of any adverse decision at the High Court, it may result in termination of the appointment given to the wards under LARSGESS.

3. It may also be made clear that in the event of termination of appointment granted to the wards of the Railway employees in future, the Railway employees (parent of ward who got appointment under LARSGESS) who tendered voluntary retirement will not get back their appointment. An undertaking in this regard, may be taken from the employee as well as the candidate to this effect, clearly witnessed by two co-workers and forwarded by the supervisor concerned under signature With designation stamp and office seal.

Therefore, further necessary action may please be taken accordingly, as the case is still pending before the Hon’ble High Court.
